This Terms of Use Agreement sets forth the standards of use of the JRRENT.COM Online Service. By using the JRRENT.COM website you (the “Member”) agree to these terms and conditions. If you do not agree to the terms and conditions of this agreement, you should immediately cease all usage of this website.
We reserve the right, at any time, to modify, alter, or update the terms and conditions of this agreement without prior notice. Modifications shall become effective immediately upon being posted atJRRENT.com website. Your continued use of the Service after amendments are posted constitutes an acknowledgement and acceptance of the Agreement and its modifications. Except as provided in this paragraph, this Agreement may not be amended. JRRENT.COM has the right to enforce the Terms of Use Agreement and any other policy of this site, which may include legal action.
- Definitions
“JRRENT.COM”, “JRRENT”, and “Site”, are defined as the website http://www.jrrent.com and any of its subdomains. These terms also are defined in this document as the owner of this Site or any entity that is a designated representative acting on behalf of the Site owner.
“Member” and “Members” are defined as any registered person of this Site.
“Owner” and “Owners” are defined as anyone who lists an item for rent on the Site.
“Renter” and “Renters” are defined as anyone who rents an item from a Site Owner.
“Service” is defined as the service or services provided by this.
- Description of Service
JRRENT is a website for the purpose of bringing together people interested in renting items to others with people interested in renting items for use. Member must provide (1) all equipment necessary for their own Internet connection, including computer and modem and (2) provide for Member’s access to the Internet, and (3) pay any fees relate with such connection.
JRRENT is a solely a place for Owners and Renters to come together, and is not a party to any agreements or contracts between the Owners and the Renters.
JRRENT does not warrant the accuracy of any information posted on the Site, nor does it have control over any safety requirements, legal requirements, or the quality of the items listed. JRRENT has no control over the description of any item, or of the ability of the Owner to provide the listed item as described.
Proper and safe use of any rented items is not under the control of JRRENT, and the responsibility for this lies with the Owners and the Renters.
JRRENT is not responsible for the collection, holding, or refunding any security deposits. Security Deposits or other guarantees issued for the items rented are the responsibility of the Owners and Renters, and are not the responsibility of JRRENT. JRRENT does not have any control over, or offer any warranties, as to collecting money due to the Owner from the Renter or the money due to the Renter from the Owner.
JRRENT is not responsible for the identity of any member.
- Disclaimer of Warranties.
The Site is provided by JRRENT on an “as is” and on an “as available” basis. To the fullest extent permitted by applicable law, JRRENT makes no representations or warranties of any kind, express or implied, regarding the use or the results of this website in terms of its correctness, accuracy, reliability, or otherwise. JRRENT shall have no liability for any interruptions in the use of this Website. JRRENT disclaims all warranties with regard to the information provided, including the implied warranties of merchantability and fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow the exclusion of implied warranties, therefore the above-referenced exclusion is inapplicable.
- Limitation of Liability
JRRENT SHALL NOT be liable for any damages whatsoever, and in particular JRRENT shall not be liable for any special, indirect, consequential, or incidental damages, or damages for lost profits, loss of revenue, or loss of use, arising out of or related to this web site or the information contained in it, whether such damages arise in contract, negligence, tort, under statute, in equity, at law, or otherwise, even if JRRENT has been advised of the possibility of such damages. SOME JURISDICTIONS DO NOT ALLOW FOR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, THEREFORE SOME OF THE ABOVE LIMITATIONS IS INAPPLICABLE.
- Prohibited Uses
JRRENT reserves the right to close at any time any member accounts for any reason, including but not limited to the following prohibited uses.
You will not add any content in any way that:
- In any way depicts, promotes, or incites pornography, vulgarity, violence, or hatred.
- Depicts any kind of nudity, including graphic art or cartoons.
- Harms or intends to harm another individual’s personal property, including their computer, or attempting to bypass the security systems of other computers or web servers, including but not limited to any activity that can be considered spamming.
- Provides content or links to other sites that violates the terms of use of this Site.
- Contains advertising for money making schemes, discount cards, credit counseling, online surveys or online contests.
- Attempts to obtain any private information that personally identifies any minor.
- Can be in anyway perceived as detrimental to other individuals or exploits minors.
- Misrepresents in anyway the source of anything that you post to this Site, including implying implicitly or explicitly that you are another entity or individual.
- Attempts to obtain any private information that would invade any individual's privacy, including personal account information, credit card numbers, passwords or any other contact information.
- Would be considered unethical, including any unethical advertising, or misrepresentation in postings to the Site.
- Violates the Terms of Use Agreement.
- Violates any other Site Policies.
While offensive postings on the Site are prohibited, some offensive material may slip through. Members agree to report to the administrator offensive postings, and Members also agree that they may be inadvertently exposed to offensive material. JRRENT will have the sole discretion as to what postings will be removed. JRRENT also reserves the right without limits or restrictions to modify any listing, including removing parts of a listing or the listing entirely.
Members will not hold JRRENT or its owner liable in any way for closing a member account. This includes but is not limited to claims for any damages or demands.
Members must agree that they are adults allowed to enter into legal contracts. Minors may not establish accounts with the Site or use its services.
Members agree to keep their accounts personal, cannot share their passwords, and all activities under a given username and password are accepted by the member as proof of the use of this Site by that member. Comments posted must be posted solely by the user with that assigned username and password. Members agree to keep their username and password confidential.
Members agree to provide valid email addresses for communications with other members and the Site. Members also agree to provide valid location addresses for the purpose of exchanging items. The location address may be a public area for the exchange to occur if the item is transportable should the Owner choose to have the transaction occur someplace other than where the item is located due to privacy concerns. For example, a homeowner may not wish to rent out an item listing their home address. Real estate listings must be the valid location of the real estate.
Posting of fraudulent information is prohibited.
Members agree to post fair and honest evaluations in the Site. Trust in the Site as well as other Site Members is built upon the rating system. Members should consider it their obligation to the other Site Members to use the evaluation system to fairly reflect their honest opinions. Dishonest evaluations for the purpose of discrediting another member are prohibited.
Automatic submissions or postings by any device or by any computer program is expressly prohibited.
- Site Fees
The Site fees are listed in the current Pricing Policy. The Site Fees are subject to change without any notice or prior approval from any members.
There is no fee paid to the Site by the Renter. Owners are charged a commission fee on their transactions.
- Rental Listings
Rental Listings by the Owner must be as accurate as possible, and the Owner must have the legal rights to place the item up for rent. Members must have the legal right to all intellectual property in their posts to the Site. JRRENT cannot be aware the content of every post in the Site and whether the Member who placed the post has the legal right to the intellectual property in the post, but JRRENT will make every effort to remove any posts that violate copyright laws as soon as possible when notified.
Fees must be listed in the Rental Listing. The description must not include contact information, contact must occur solely through the Site email communication system. It is up to each member to verify that emails from the Site correctly go through and are received by the member. There is a link to send yourself a test email from the Site.
The Owner is responsible for the content of the rental agreement. The example rental agreement in the Site may be used by the Owner to modify or adjust to fit his or her own individual needs. Members agree that JRRENT is not responsible for the content of this example contract or any contract between the Owner and the Renter. The example contract is provided by JRRENT as a courtesy to the Members to use a starting point. JRRENT recommends that members seek competent legal advice prior to entering into a legal contract. The legal contract for renting an item is between the Owner and the Renter, and JRRENT is not a party to this contract. Owners may upload to the Site their own personalized rental agreement for use with their rentals.
Owners cannot change the price of the rental once a rental is accepted.
Locations published on the Site and markers placed on maps are approximate. Members agree to the Terms of Use of Google Maps.
- Contact between Owner and Renter
The rental of any item between the Renter and the Owner brought together by the Site can only be done through the Site, and communication is only to be done through the email communication system of the Site. Exchange of telephone numbers, contact information, business address, website addresses, fax, email address, or location is prohibited. Once a rental request has been submitted, and the request has been accepted by the Owner, contact information for the purpose of completing the transaction is permitted. Once an Owner accepts the rental request from a Renter, the Owner and Renter agree that the contract between them is binding.
- Precautions
As with any interaction with other people on the web, Members need to take precautions to insure their safety. The vast majority of Members using the Site are legitimate individuals seeking to rent item or provide items for rent. It is the sole responsibility of each Member to act in a way to insure his or her own safety. JRRENT cannot control who makes posts on the Site or what their intentions are.
- Independent Entities
JRRENT and its Members are independent parties acting on their own, and nothing in this Terms of Use Agreement or any other Site policy shall be interpreted in a way that implies a partnership between JRRENT and any of its Members.
- Indemnification
Member agrees to indemnify and hold JRRENT, its parents, subsidiaries, affiliates, officers and employees, harmless from any claim or demand, including reasonable attorneys’ fees and costs, made by any third party due to or arising out of Member’s use of the Service, the violation of this Agreement, or infringement by Member, or other user of the Service using Member’s computer, of any intellectual property or any other right of any person or entity.
- Modifications and Interruption to Service
JRRENT reserves the right to modify or discontinue the Service with or without notice to the Member. JRRENT shall not be liable to Member or any third party should JRRENT exercise its right to modify or discontinue the Service. Member acknowledges and accepts that JRRENT does not guarantee continuous, uninterrupted or secure access to our website and operation of our website may be interfered with or adversely affected by numerous factors or circumstances outside of our control.
- Third-Party Sites
Our website may include links to other sites on the Internet that are owned and operated by online merchants and other third parties. You acknowledge that we are not responsible for the availability of, or the content located on or through, any third-party site. You should contact the Site administrator or webmaster for those third-party sites if you have any concerns regarding such links or the content located on such sites. Your use of those third-party sites is subject to the terms of use and privacy policies of each site, and we are not responsible therein. We encourage all Members to review said privacy policies of third-parties’ sites.
- Disclaimer Regarding Accuracy of Vendor Information
Product specifications and other information have either been provided by the Vendors or collected from publicly available sources. While JRRENT makes every effort to ensure that the information on this website is accurate, we can make no representations or warranties as to the accuracy or reliability of any information provided on this website.
JRRENT makes no warranties or representations whatsoever with regard to any product provided or offered by any Vendor, and you acknowledge that any reliance on representations and warranties provided by any Vendor shall be at your own risk.
- Governing Jurisdiction of the Courts Florida
Our website is operated and provided in the State of Florida. As such, we are subject to the laws of the State Florida, and such laws will govern this Terms of Use, without giving effect to any choice of law rules. We make no representation that our website or other services are appropriate, legal or available for use in other locations. Accordingly, if you choose to access our site you agree to do so subject to the internal laws of the State Florida.
- Compliance with Laws.
Member assumes all knowledge of applicable law and is responsible for compliance with any such laws. Member may not use the Service in any way that violates applicable state, federal, or international laws, regulations or other government requirements. Member further agrees not to transmit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national, or international law or regulation.
Members agree that they are solely responsible for complying with all applicable tax laws. Members agree that they will determine the amount of taxes they owe from any activities related to this site, and that they will pay these taxes. JRRENT does not pay any taxes on behalf of any Members of the site.
Members agree that they will be responsible for complying with any certification or licensure requirements that may apply to them for them to conduct business on the Site. Members agree that it is not the responsibility of JRRENT to either provide licenses or certifications, or to verify that any Member complies with all certification or license requirements for them to do business on the Site. JRRENT provides no guarantee regarding licensure or certifications of its Members.

All content included or available on this Site, including Site design, text, graphics, interfaces, and the selection and arrangements thereof is ©2005 JRRENT.com, with all rights reserved, or is the property of JRRENT and/or third parties protected by intellectual property rights. Any use of materials on the website, including reproduction for purposes other than those noted above, modification, distribution, or replication, any form of data extraction or data mining, or other commercial exploitation of any kind, without prior written permission of an authorized officer of JRRENT is strictly prohibited. Members agree that they will not use any robot, spider, or other automatic device, or manual process to monitor or copy our web pages or the content contained therein without prior written permission of an authorized officer of JRRENT.
JRRENT™ and JRRENT.com™ are proprietary marks of JRRENT.com. JRRENT’s trademarks may not be used in connection with any product or service that is not provided by JRRENT, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits JRRENT.
All other trademarks displayed on JRRENT’s website are the trademarks of their respective owners, and constitute neither an endorsement nor a recommendation of those Vendors. - Botnets
JRRENT retains the right, at our sole discretion, to terminate any accounts involved with botnets and related activities. If any hostnames are used as command and control points for botnets, JRRENT reserves the right to direct the involved hostnames to a honeypot, loopback address, logging facility, or any other destination at our discretion.
- Other Terms
If any provision of this Terms of Use Agreement shall be unlawful, void or unenforceable for any reason, the other provisions (and any partially-enforceable provision) shall not be affected thereby and shall remain valid and enforceable to the maximum possible extent. You agree that this Terms of Use Agreement and any other agreements referenced herein may be assigned by JRRENT, in our sole discretion, to a third party in the event of a merger or acquisition. This Terms of Use Agreement shall apply in addition to, and shall not be superseded by, any other written agreement between us in relation to your participation as a Member. Member agrees that by accepting this Terms of Use Agreement, Member is consenting to the use and disclosure of their personally identifiable information and other practices described in our Privacy Policy Statement.
